What pitfalls are there if works contracts and service contracts are improperly executed?
An inadequate definition of successful performance or the performance specification
The selection of the executor is the sole responsibility of the contractor in the contract for work or services. The client may not influence the selection.
The authority to issue instructions lies solely with the contractor in the works or service contract. The client may not issue direct instructions to the executors.
Giving executors assignments beyond the agreed trades. Integration into the client’s workflows is not permissible. The planning freedom lies exclusively with the contractor.
